The Licensee's creditors _have successfully converted thelreorganiza--

tion of AlChemIE, (under ChapterallL of USC)!which: AlchemIE.Thad

sought in the United States _ Bankruptcy Court for the Eastern' District: of Tennessee:(Case No.- 89-01095RS-11A)= to a liquidation proceeding to dispose of AlChemIE's assets, under Chapter 7. of 11' USC (Case No. 3-89-01695).. Swi ft ' Affidavit at ' 1-2.

This fact,!in and of itself, < reconfirms the finding lmade by the S' taff in; the -

ei August 18, 1989, Order-(at page 3)' that. AlCheia12 has not ~and cannot 1

demonstrate that it is financially qualified to conductithe-activities authorized under its construction permitse Nor, under' the circumstances, can one reasonably: expect that'it will' be able to do so-in the future. Id..at 2.

As a result of the Chapter 7_ bankruptcy proceeding, the. Licensee.has
