Dear Senator Simon:

I am responding to your letter of April 25, 1990, in which he enclosed a copy of a letter from Ms. Phyllis Radtke expressing concerns about a proposed nuclear waste facility near her hometown of Ontonagon, Michigan.

When Congress passed the Low-Level Radioactive Waste Policy Amendments Act of 1985, it assigned responsibilities to various entities for safely disposing of LLW. The Nuclear Regulatory Commission (NRC) is responsible for promulgating regulations designed to protect the public health and safety and the environment.

At this time, it is also responsible for reviewing a license application for a site in Michigan, and if the site is found to be in conformance with NRC regulations in 10 CFR Part 61, to issue a license for disposal of low-level radioactivewaste(LLW).

Michigan, as the host State for the Midwest Compact, is responsible for selecting a suitable site for a LLW disposal facility that can fulfill the Commission's requirements in 10 CFR Part 61. The Midwest Compact is composed of the States of Ohio, Michigan, Indiana, Iowa, Minnesota, Missouri, and Wisconsin.

After Michigan has fully characterized a potential LLW site, the State must submit a license application to the NRC for a licensing decision. The NRC will issue a license only if it can be demonstrated that the public health and safety and environment are adequately protected.

I am enclosing a copy of our final rulemaking on land disposal of LLW (10 CFR Part 61), as well as a publication that provides background material on the regulation and NRC's responsibilities in this area.

As we understand it, the State of Michigan recently eliminated Ontonagon County, Michigan as a potential location for a LLW disposal facility. For additional information about the Michigan siting process you may write to Mr. James F.
