u' The Honorable Alfonse M. D' Amato May 1.4, 1990 United States Senate Washington, DC 20510 Dear Senator D'Amato This is in response to a letter from one of your constituents, Mr. Arin Zier, related to the disposal of radioactive waste. The letter was forwarded to the i
i U.S. Nuclear Regulatory Commission (NRC) by the U.S. Federal Energy ReDulatory l
Commission (FERC).
In his letter, Mr. Zier alludes to problems with current low. level radioactive waste disposal practices in the U.S.
Although there have been small releases of certain radionuclides from three of the commercial sites formerly used to dispose of waste in the U.S., the releases do not pose a threat to the environment or man, However, they do point out the need for everyone involved in waste disposal to do a better job in the future in providing for safe i
disposal of nuclear material. That is why, in 1983, the NRC promulgated regulations, 10 CFR Part 61, to set a uniform national standard for safe disposal of low. level radioactive waste.
In Mr. Zier's letter, he referred to the 1980 law that gives States the responsibility for disposal of low-level waste, the Low. Level Radioactive L
Waste Policy Act. All the States are currently undertaking a process that will lead to disposal capacity on a regional basis, or in some cases, on an l
l individual basis by the mid 1990's. The State of New York, through the l
New York Low. Level Radioactive Waste Siting Commission, is currently developing disposal capacity for low-level radioactive waste originating in the State of New York.
For further information on the status of the Siting Commission's progress in this matter, please contact: Jay Dunkelberger, Executive Director, l
New York Low. Level Radioactive Waste Siting Commission,1215 Western Avenue, i
l Albany, New York 12203.
Mr. Zier also raised the issue of safety of on-site storage of low-level waste at reactors while a site providing for safe disposal is developed. Nuclear power plant licensees are required to store their waste in accordance with strict safety standards contained in the NRC's regulations. The NRC staff reviews these licensee programs and conducts periodic inspections at their facilities to help ensure that wastes are being safely handled.
I trust this response clarifies our position.
