Dear Mr. McGranery:

1 By letter dated May 4, 1990, regarding our earlier phone conversation of that,

'date in connection with the issuance of amendments to the Shoreham operating license relating to the Physical Security Plan and Emergency Planning, you requested that I-confirm your understanding that I voluntarily agreed to. stay i

staff action on these matters until May 15, 1990.

In e second letter also of that date, you make a similar request with respect to these amendments such that the staff's action would coincide with the effectiveness of the exemption granted to long Island Lighting Company on April 30, 1990 concerning on. site property insurance, the exemption's effectiveness having been deferred for 10 working days.

In each instance, you request that staff action be stayed so as to permit you to seek judicial intercession.

l Please be advised that while 1 did agree that the effectiveness of any staff action with respect to these two license amendments would be stayed until May 15, 1990, the-basis for my agreement is the current status of the staff review effort.

It is extremely unlikely that the necessary reviews will be-completed so as to permit issuance of the amendments prior to.that date.
