Dear Mr. Matthews:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the preliminary final Remedial Action Plan (RAP) and all associated documentation pertinent to the proposed remedial action for the inactive mill tailings sites et Rifle, Colorado. Our review is documented in the enclosed dr6ft Technical Evaluation Report (TER), which discusses the NRC staff's evaluation of the proposed remedial action for compliance with the EPA standards.

Based on our review, the NRC staff has identified significant open issues in geotechnical engineering, hydrology, and redon attenuation and site cleanup.

These are sunnarized in Table 1.1 of the TER and discusced in detail in the appropriate TER sections.

Until these open issues are resolved, the NRC is not arepared to conditionally concur in the DOE's remedial action plan. After you lave had time to review this document, we would be pleased t' meet with you to discuss the results of the review and resolution of these issues. The information to resc1ve the open issues should be provided in the finni RAP.
