to discuss the management of non oower reactor (NPR) inspections.: G. Holahan l

opened the meeting by outlining tse concerns that the NPR community, represented i

bytheTestResearchandTrainingReactor(TRTR) organization,hadwith.regardto NPR inspections and gave a sumary of events that have taken place in this. area.

He noted that the NPR comunity believes that they are Leing inspected with a 4

power reactor mindset, which is beyond that called for in the' Atomic Energy Act.

He reviewed the request by TRTR to have all NPR inspection functions transferred-to Headquarters and the reason why the Headquarters staff recomended to the Comission that inspections still be conducted by the Regions, i.e. the need for continuity and expertise in handling emergency situations, dealing with State-and local officials and'the media, and being familiar with the facility in-the event of an incident-However, the decision to have inspections conducted by the Regions is not irreversible and although most Regions have responded to a more focused NPR inspection program,. the function could still be transferred to Headquarters.

It was noted that TRTR representatives are meeting with Comissioner Remick, the Commissioner's Assistants and the EDOLon ' separate occasions during the week of May 1,1990, to promote among other things'that '

inspections be conducted out of Headquarters.

The question as to whether NPR inspections conducted in the past have'contri-buted to the shutdown of NPRs was discussed. Some thought that wasn't the case.

l however, mention was made that college administrators, in light of' declining nuclear enrollment, do not want to be confronted with negative reports about nuclear reactors on their campus and thus close down the facility.. A speech given by Commissioner Rogers at the University of Virginia noted that nuclear I

L training in the U.S. is being affected by the closing of NPRs at universities.

The Cintichem closing and the reason for this was discussed. Although the primary reason for the closing war, the withdrawal.of Amersham from the acquisi-i tion of the rebetor and hot cell facilities, the secondary reason was the possi-I ble legal actions being contemplated by groups in N.Y. State.

It was noted that although leaks should be dealt with seriously, that leaks occur in NPRs and are dealt with in an appropriate manner.

C The point was made that the safety concerr.s for most NPRs were radiological health and safety and that is where our focus should be for inspections. A Region 1 memorandum on the Transfer of Management Responsibilities for.Non-Power Reactors from DRP to DRSS has been concurred in by W.F. Kane and M.R. Knapp and approvedbyT.T. Martin (Enclosure 2). Completion of this transition should improve the inspection of NPRs in Region I because the emphasis is where it 1

4 2-should be and it would be consolidated among a few individuals who are> trained

.for this purpose. The importance of the NPR training-course was acknowledged by i

the Region.

They are planning to send 3-4 individuals and Mel Knepp is also considering attending.- It is expected that the next course will be given in 1

July 1990, a

The revision of inspection. procedures was discussed with the suggestion that'a committee from all Regions be formed to review and revise these procedures over a 3-4 day period. Another suggestion was to have only individuals from 2 or 3

Regions who are knowledgeable to perform this function i.e., depth rather than i

breadth. Region I expressed a willingness and desire to participate in upgrading the NPR inspection procedures..

At the next TRTR conference,~ scheduled for October 1990, the NRC will hold a one-day seminar preceding the conference. The Regions will be expected to par-1 ticipate. Additional details will-be forthcoming.

4 TRANSFER OF MANAGEMENT RESPONSIBILITY FOR NON POWER-

SUBJECT:

REACTORS The purpose of this memorandum is to outline the scope and actions necessary i

to transfer responsibility for the management of the Non-Power Reactor (NPR) program within Region I from DRP to DRSS, specifically the Effluents Radiation Protection Section (ERPS)

This: transition has been proposed to occur in FY 1990, and therefore special note should be made as to the actions that need to be-completed coincident with any transition of responsibility.

Table I is a listing of the NPRs within R1 by. license number, operating class and safeguards class. Of there 18 facilities, three are in various stages.of Watertown), and thus will being dismantled (Saxton, Westinghouse, U.S. Army ic needs of the facility as require an inspection program gared to the specif it enters the various stages of-decommissioning.

Of the remaining 15 facilities, six are operability class I facilities, eight are class !!, and one is class !!!. With regards to safeguards class, seven are classified as Moderate Strategic Significance (MSNM) and eight are classified as Low Strategic Significance (LSNM).

A class I NPR is defined as a reactor of 2MW or greater, class !! as less than 2MW, and class !!! as NPRs on extended shutdown or decommissioned. The j

safeguards categories of Moderate Strategic Significance (MSNM) and Low J

Strategic Significance (LSNM) are defined in the Inspection and Enforcement Manual, Chapter 2545, Table 5 (copy attached).

As shown in Table 2, depending upon the operation and safeguards class of the i

facility, any given NPR is subject to inspection against 18 inspection modules, plus an additional 10 modules are utilized on an as needed basis.

NRC personnel conducting inspections at MPRs are required to have received-J j

specialized NPR training.through the Technical Training Center (TTC) or be accompanied by an-inspection who was so trained. At present, the TTC course is under revision, and it is not anticipated that presentation of. this course will occur again before June / July 1990. At the present time no Region ! DRSS inspector his been through the course, although Mr. Roth had received some training in NPR inspection about seven years ago.

In order to provide for an orderly transition, the following steps with estimated completion dates are proposed:
