Dear Mr. Morris:

In response to your letter of August 28, 1989, I am enclosing the Nuclear Regulatory Commission (NRC) staff's biennial report on progress in implementing the " Federal Guidelines for Dam Safety." The report covers the period from e

October 1987 through September 1989.

As a result of discussions with the NRC staff related to the biennial report and the Federal Emergency Management Agency (FEMA) Report, " National Dam Safety Program - 1986 and 1987 - A Progress Report," that contained your agency's assessment of the NRC's implementation of the Federal Guidelines for Dam Safety; I have directed the staff to develop a new program plan for dam safety by October 1990. This program plan will clearly describe how the NRC will implement the Federal Guidelines on Dam Safety. We believe that certain elements of what will become part of the plan are already in use by the NRC.

For example, we.already have design and construction criteria for dams in a number.of our Regulatory Guido documents and requirements addressing the safety and stability of impoundments for uranium mill tailings management in our I

regulations. The program plan will integrate existing requirements and guidance, and identify those areas-of the Federal Guidelines that need to be more fully addressed by the NRC.

Mr. John Greeves Deputy Director of NRC's Low-Level Waste Management and Decommissioning Division, will be responsible for the development of our program plan.- He also will serve as NRC's Dam Safety Officer. Once our i

program plan has been developed, the cognizant NRC staff personnel will meet l

with FEMA representatives to di. scuts whether.we.have. been able.to. clearly addres~s ths Federal ~ Guidelines. The NRC intends to then implement the program and provide more definitive information in the next biennial report.

I trust this response clarifies our plans for implementing the Federal Guidelines.
