Dear-Senator Metzenbaum:

I am responding to your letter of March 9,1990, in which you enclosed a copy of a -letter from your constituents, Ms. Julie Carter and Ms. Susan Drabek, 1

requesting'information on State and Federal regulations concerning "...the

proposed landfill in Riga Township." As we understand it, the State of-liichigan has identified Riga Township, Michigan as a potential location.for a -low-level radioactive waste !(LLW): disposal facility.

Michigan, as the host State for the Midwest Compact, 1s' responsible for selecting a suitable site for a LLW disposal facility, as provided under the

. provisions in the Low-Level Radioactive Waste Policy Amendments Act of 1985.

.(The Midwest Compact includes the States of Ohio, Michigan, Indiana, Iowa, Minnesota,MissouriandWisconsin.)

After a host State has fully characterizeo a potential LLW disposal site, the State or its developer must submit a license application to the Nuclear Regulatory Commission (NRC), or a State licensing authority, for a licensing 1

-decision.

If a State is to license a LLW disposal site, the State must have a licensing program that is equivalent to that of the flRC.

10 CFR Fart 61 details licensing procedures, developed by NRC, that provide a 1

framework to assure that all potential health and safety and environmental impact questions are thoroughly reviewed.

I am enclosing a copy of our final rulemaking on land disposal of LLW (10 CFR Part 61), as well as a publication that provides background material on the regulation and NRC's responsibilities in this area.
