SUBJECT:
FINAL REGULATORY GUIDE ON FINANCIAL ASSURANCE FOR NUCLEAR REACTOR DECOMMISSIONING transmitted a revised final package providing guidance to -
licensees and.the NRC staff in addressing the requirements in the decommissioning rule amendments with regard to financial aspects.
The package has been revised in response to public comments, and the final guide has been reviewed and concurred in by NRR and NMSS, with OGC indicating it has no legal objection. The recommendations in the proposed guide do not extend current regulatory requirements, but only provide guidance for satisfying the requirements of the decommissioning rule.
RES believes that the impact on industry and the NRC staff are minimized to the extent practical and that NRC resource reductions should result from this action.
RES also suggested that, in view of the above factors.and other considerations outlined in Enclosure 1, the_CRGR might not-feel the need for a formal staff presentation.
The CRGR staff has reviewed the final guide and believe it is generally responsive to the Committee's two relatively minor comments provided to the EDO last year (Enclosure 2). The CRGR staff has prepared a memorandum to RES (Enclosure 3), which requests additional changes to the guide to reflect CRGR's comments fully.
In addition, the implementation section of the guide has been revised in accordance with the standard language for implementing the backfit rule, as requested by the CRGR, but an additional change is needed to clarify a sentence in this section.
Please review the revised package and let me know within 5 working days if you believe further consideration at a CRGR meeting is needed.
If I do not receive any such requests, I will send the draft memorandum provided in Enclosure 3.
