APPLICATION-OF SUPPLEMENTAL' STANDARDS AT VICINITY 4

Background-4 a

9 O

-The Radiological and Engineering Assessment (REA),1 Revision 1,,for vicinity-

' property numbers DU-544/545 was-originally submitted on September 13, 1989, in

[J which the Department of Energy-(DJE) requested NRC concurt.ence on the- - +

. application of supplemental standards. -Additional REA'submittals were.made on s

February l14,-1990, and April 24'--1990.

Discussion 7

g q

1 The! proposed' remedial action is to apply supplemental standards to-3 y2

- approximatelyL733,680 squa're yards (about 150 acres) of open' land _on Smelter Mountain,' owned by the S+ ate of Colorado-(DU-545) and private parties'(DU-544).

l

^

4 The area exhibits the characteristics of windblown contamination with the soil.

sampling results sporadically ranging from less:than;1.3 to-205 pCi/g.

The

?4 hillsidesf reportedly have an; average grade of 75 percent, naking-cleanup-of the p"

' deposits difficult.

DOE estimated that' cleanup costs for DU-544 to be about 1 million dollars and about' 5 million dollars for DU-545.

The proposed 7' '.

remedial action is to leave the contsmination in place.

l}4-f;,

' DOE:has-applied for supplemental standards for these two properties based on

~

E,

-the high cost rchtive.to long-term benefit (40.CFR 192.21c) and potential risk of in' jury.to workers during cleanup operations (40 CFR 192.21a). Additionally stressed is the potential harm to the environment resulting from cleanup j

operat, ions.

Their assessment of the radiological hazard'to-tk public is based L

oncthe; assumptions that, there will be no change in the current ' land use.

The f

private landowners,:however, base indicated that they may not agree with the L

assumption that the land is uninhabitable.

00E was therefore requested by-

.i

letter dated January 12,'1990, to readdress.the hazard assuming the area is t

L Ui sE.

concentration.would not exceed the allowable limit
of 0.03'WL.-

Conclusion' The' location of the contaminated material, the, fact that t'he land use is'not likelylto change, and the' low.public' health hazard compared to the cost of" complete.remediation.' justify the-' application of-supplemental standards for

these properties. 7 Ths REA dated January 22, 1990', meets thel criteria established in

.40 CFR 192.21(c) necessary to apply supplemental standards'.

The proposedi

remedial actions are ' reasonable under the circumstances and' the requirements _of.,

140 CFR 192.22(a)'are therefore satisfied.

The staff concurs with-00E that.

supplemental standards be applied for. vicinity property numbers D0-544/545S.
