NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Tennessee Valley Authority (EA 89-239)

(Browns Ferry)

Subject:

PROPOSED IMPOSITION OF CIVIL PEhALTY - $18,750 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $18,750 will be issued on or about May 2,1990 to Tennessee Valley Authority. This action is based on the licensee's failure to conduct an adequate annual inventory of licensed naterial which resulted in the discovery, in a later inventory, of 26

discrepancies. Although this violation was classified at Severity Level IV, l

the licensee had been cited on two previous occasions for similar violations.

l Therefore, the staff determined that a civil penalty was warranted.

The adjustment factors in the Enforcement Policy were considered in determining the j

amount of this civil penalty and the bcse amount of the penalty was mitigated by 25% because the licensee identified th discrepancies and by 50% for the licensee's corrective actions.

However, the base amount was escalated by 100%

l due to the multiple examples of the violation.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

l Mailing of Notice May 2, 1990 Telephone Notification of Licensee May 2, 1990 The State of Alabama will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

I Following NRC evaluation of the response, the civil penalty may be remitted, I

mitigated, or imposed by Order.
