Contract NRC-04-89-051,1 Task 071 Regulatory Analysis Support of proposed Rule 6nterr.ing Periodic Updates of Criminal llistory Che:ts OBJECT IVE : The Regulatory Analysis Section within the Regulation Development Branch (RDB) has been approached by the Operations Section,. also within the RDB,'to develop a regulatory analysis and _hackfit analysis -in support of a proposed rule - concerning periodic updates of crirainal history checks. 'This task isEto provide the necessary analyses. ' BACKGR00!!D: Th, proposed rule would amend' the present regulation to require periodic updates of FBI criminal ' history checks for reinvestigation of-individuals granted - l' unescorted access to nuclear power plants.or access to safeguards'information. The current regulation requires each licensee who is authorized to operate a - J I nuclear-power plant under part 50 to submit fingerprint cards to the NRC for-those individuals who are permitted unescorted access to a nuclear power facility or to safeguards information and who are not exempted under_ 73.57(b)(2). Fingerprints are used to secure a review of the' individual's criminal history record by the FBI. Information received from the FBI is j reviewed by the licensee in order to determine whether further unescorted - access to the facility or to safeguards information should continue to be- ~ ! granted or denied. The current regulation does not include a reinvestigation j ) element. This rule change will be effected by amending 10 CFR 73.57, " Requirements for Criminal History Checks of Individuals Granted Access = to a Nuclear power-Facility or Access to Safeguards Information by power Reactor Licensees".:The- ^ uen ment uculd require that licensees who operate a nuclear power plant submit f myrprint cards for cppliccble personnel to the~ URC for criminal history chc:ks every five years. D RESULTS: The contrcctor shall prepare a regulatory impact analycit (f'l A)-f or the subject action which conforms in format to the guidance available in flVREG/BR-0058, Revision 1,," Regulatory Analysis Guidelines of the U. S. !!uclear Regulatory Commission." tiay 1984. The RI A shall include the following distinct sections: Statement of the problem; Oh.iectives; Alternatives; Consequences (costs and- ' meNts of nlte-tives In lue-ir pact tnalysis), ir.:pects o'! ether requirements, constraints); Decision Rutionale; and implementation. The contractor shall also prepare a bactfit analysis that will draw upon the data l and analyses developed in the RI A. There are certain common elements between this proposed p! A and the RI A previously prepared by the contractor for the Access Authorizatica Rule. Applicable cost estimates and underlying assumptions from the Access Authorintion Rule RI A should be transferable whenever possible. l The alternatives to be considered in this RlA include no action, the proposed rule as specifici in the background section above, and requirements consis+ent with current practices for the reinvestigation of L clearances. DalVERABLES: The contractor shall deliver to the I;RC both a draft report and a final report. The draft report shall be due four weeks from the date this task-is officially in-place. This report will contain both the klA and the Backfit Analysis. A -i final report from the contractor will be due two weeks after receipt of HRC's comments on the draft report.
