Dear Mr. Matthews:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the preliminary final Remedial Action Plan and Site Design (RAP) and all associated documentation pertinent to the proposed remedial action for the
(
uranium mill tailings site at Ambrosia Lake, New Mexico.
Our review is

documented in the enclosed Draft Technical Evaluation Report (TER), which t
discusses the NRC staff's evaluation of the proposed remedial action for l
I compliance with the EPA standards.
Based on our review, significant open issues exist.
Once the outstanding items f
have been satisfactorily resolved, the NRC will be in a position to provide l
concurrence in the proposed remedial action.
The draft TER documents all outstanding items and the means for resolution.
The issues are related to long-term stability of ~the tailings pile and EPA ground-water standards.
A summary of these issues is found in Table 1 of the TER.
