INTERVENORS RESPONSE TO LICENSEE'S NOTICE OF DEPOSITION Intervenors wish to clarify the record concerning additional depositions of the NRC staff which have been noticed by Licensee for April 9 and 16.
Pursuant to the Order Following Special Prehearing Conference, dated January 21, 1982, as amended by Order of June 16, 1981, the time for initiating discovery in this proceeding ended on August 11, 1981.
Intervenors therefore oppose additional discovery by Licensee at this time.
.However, because the subject matters of the two proposed depositions rektte to contentions that were modified by this Board in the Order Concerning Summary-Disposition, dated February 19, 1982. Intervenors are not objecting to-these two depositions.
We do not object to this late discovery on what are partially new issues.
