Dear Administrative Judges:

3 In our recently submitted status report on discovery (dated March 15, 1982) we requested that the Board set a beginning date for the filing of summary disposition motions. Mr. Hirsch called to inform me that he intended to make his own request regarding scheduling matters but could not do so until he had an opportunity to examine the amendments we will be making to the 5

  • 2 application. }!r. Hirsch was concerned that our requ. cst to the J Board appears to urge the setting of a summary disposition date prior fo the time we would be submitting our amendments ,to the application. .

Our request to the Board was not intended to deny Mr. Ilirsch a fair opportunity to inform the Board of his own scheduling preferences. At Mr. Ilirsch 's request, I agreed to clarify the scheduling request contained in our status report.

Applicant expects that it will be amending its cpplicantion within the next two (2) or three (3) weeks. After examining the extent of any "new information" that may be contained in the amendments, the parties will be able to make cpecific' requests relating to scheduling matters. Applicant is not urging the Board to-set any schedule before the parties have received Applicant's amendments and have had an opportunity 8203310512 820323
