Dear Mr. Leventhal:

In a February 2,1982 letter, The Nuclear Club, Inc., and thirteen other organizations requested the Commission to hold a public hearing on its nuclear export policy.

You noted that the Commission had advised Congress that it had concerns regarding the IAEA safeguards system and that the Commission was reevaluating its export licensing responsibilities in light of the concerns.

In your letter you stated that the Commission could not establish a full record if it limited its i;

deliberations to confidential presentations by the NRC staff and Executive Branch agencies.

The Commission has given careful consideration to the request and determined that public hearings would not assist the Commission in its reevaluation of its export licensing responsibilities.

In the past year there have been several Congressional hearings where Congressmen, federal officials, former IAEA inspectors and representatives of citizen groups, including The Nuclear Club, Inc., have testified.

During those presentations the adequacy of the IAEA safeguards system was discussed, along with the implications of possible deficiencies, and various means to improve the IAEA safeguards system..The Commission does not believe that significant new information or analyses would be presented at NRC public hearings.

In addition, as you are aware, much of the information relating to the adequacy of the IAEA safeguards system is classified national security information.

This information could not be discussed at public hearings and therefore public hearings would be of limited usefulness to the Commission.

For these reasons the Commission has denied your hearing request.

Commissioner Gilinsky would have preferred to ask you what sort of presentation,you would make and what type of information you would bring to the Commission's attention.
