NOTICE OF VIOLATION Licensee: Miami Baptist Hospital Docket:

As a result of the inspection conducted on January 25, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition 15 requires the following reference standards to be used when performing dose calibrator accuracy and constancy tests.

Cesium-137 100 microcuries or more I

Barium-133 100 microcuries or more Cobalt-57 One millicurie or more Contrary to this requirement, Cesium-137 and Barium-133 reference standards were not available for use when performing dose calibrator accuracy and constancy tests during the period October 1980 to January 1982.

This is a Severity Level V Violation (Supplement VII.E).

License Condition 17, requires, in part, that licensed activities be conducted in accordance with statements, representations, and procedures contained in the application dated August 28, 1979.

Item 7.D of the application states that the medical isotopes committee will meet at least quarterly.

Contrary to this requirement, meetings were conducted once in the calendar year 1980.

Item 10.2 of the application states that the linearity test of the dose calibrator will be performed quarterly.

Contrary to this requirement, linearity tests were performed once each in the calendar years 1980 and 1981.

Item 12, of the application states that refresher training would be conducted annually.

Contrary to this requirement, annual refresher training had not been corducted during the period August 1979 to January 1982.

This is a Severity Level V Violation (Supplement VII.E.).

Pursuant to the provisions of 10 CFR 2.201, Miami Baptist Hospital is hereby required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) the corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

Consideration may be given to extending your response time for good cause shown.
