By date of March 5,1982, the Licensees filed a{ document 77 p.

purporting to be an answer to the motion of the NRC Staf f to strike ~'l the UCS/NYPIRG filing of January 29, 1982 objecting to the Statements of Position submitted by the NRC Staff and the Licensees with reference to the six Commission Questions. Both Licensees failed to respond to I

the UCS/NYPIRG Objections to the Licensees' Statements of Position.

The " answer" they have new submitted to the Staff Motion is in fact l a rescense to the original UCS/NYPIRG objections, entitled " answer" j to avoid the default on the objections.

UCS/NYPIRG would not have objected to a motion for an extension of time on the part of the Licensees. However, the Licensees' transparent attempt to mislead the Board and the other parties compels UCS/NYPIRG to move to strike the March 5,1982 document altogether.

s em WHEREFORE, UCS/NYPIRG respectfully move the Board to refuse to accept for filing the Licensees' March 5, 1982 document, and to deny their motion for an extension of time in which to answer the UCS/NYPIRC objections to their statements of position.
