Dear Dr. Cochran-This is in further response to Mr. Roisman's letter dated September 6, 1979 in which he requested, pursuant to the Freedom of Information Act, all documents prepared or received in connection with the preparation of NUREG-0459.
In my letter to you dated July 16, 1980, I explained that the SECRET report titled:
" GENERIC ADVERSARY CHARACTERISTICS" (U), was undergoing c
a declassification review. That review has been completed and a copy of the released portions of the report is enclosed.
The withheld portions of the report contains information classified pursuant to Executive Order 12065.
This information is being withheld from public disclosure pursuant to Exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has bet.n determined that the information withheld is exempt from production oc disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. John G. Davis, Director, Office of Nuclear Material Safety and Safeguards.
This denial may be appealed to the Comission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such at'eal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
This completes our action on Mr. Roisman's request.

Pursuant to the Freedom of Information Act, we request production of all documents prepared by or received by the Commission or any of its employees or consultants in connection with preparation of NUREG-0459 and in connection with preparation of the upgraded physical protection regulations in 10 CPR Part 73.
This request includes, but is not limited to, all comments and reconmendatio".s of all NRC employees and consultants on the positions to be taken in the two identified documents and on the facts relevant to preparation of those documents.
With respect to any classified document, or any document referred to other agencies that are not made available to me within 10 days, e.g. due to a need for classification review, I request a record identifying the title, author, date and classification of these documents.
