APPENDIX A NOTICE OF VIOLATION Consolidated Edison Company of New York, Inc.
3 4 Irving Place New York, New York 10003 Docket Nos. 50-3 50-247 50-286 Based on the results of the NRC inspection conducted on March 16-19, 1976, it appears that certain of your activities were not conducted in full compliance with the conditions of your NRC Facility License Nos.
DPR-5, DPR-26 and DPR-64, as indicated below:
A.
Section 5.4 of the Environmental Technical Specification Requirements (ETSR) for Unit 3 requires, in part, that detailed written procedures, check-off lists, instructions, etc., be prepared, reviewed, approved by the Environmental Protection Committee (EPC) and adhered to for specified activities in carrying out the ETSR.

Contrary to t'his requirement, detailed, written, reviewed and approved procedures were not available for the following required activities:
a.
Radiological environmental sample preparation and analyses by contrac: ors, i
b.
Calibration of instrumentation used in the above analyses, t

c.
Calibration, use and control of TLDs used in the environmental j
program, and i
d.
Maintenance and calibration of meteorological instrumentation.
2.
Contrary to this requirement, the detailed, written procedures related to the biological studies and monitoring programs were not reviewed and approved by the EPC.
This item is an. infraction.
B.
Section 4.1.2a(3). A of the ETSR for Unit 3 requires, in part, that fish collections be made daily from each intake screen when the corresponding circulating water pumps are in operation and the collected fish be analyzed as specified.

Contrary to this requirement, no fish collections or analyses were made at Unit 3 since February 22, 1976, during which time.one or more circulating water pumps vere in operation each day.
This item is an infraction.
C.
Section 3.3.4 of the ETSR for Units 1 and 2 requires, in part, that the pH of the discharge circulating water be measured from samples taken at least one meter and three meters depth during discharge of regenerant wastes and other. basic or acidic wastes.
x Contrary to this requirement, the pH of the discharge' circulating t'ater was not measured during discharges as stated above since becember 16,,1975.
(We note that subsequent to December 16, 1975, the pH cf discharges from the neutralization facility were monitored

Section 5.6 of the ETSR for Units 1. and 2 and also 3 requires, in part, that all reports submitted to other Federal agencies or to the New York State Department o'f Environmental Conservation (NY DEC) as a requirement of a permit or certificate involving environmental 1
- matters also be submitted to the NRC at the same time.
