SU!HARY: The Commission is publishing for public comment this notic.e of receipt of a petition for rulemaking filed before the Commission on Decerber 21, 1981, by the Citizens' Task Force. The petition, which has-been assigned Docket tio. PPJi-50-31, requests that the Commission amend its regulations in 10 CFR Farts 50 and 70 with respect to the level of emergency preparedness required to protect the health and safety of citizens and communities ic:ated near nuclear reactors.

SUPPLEMENTARY INFORMATION:

The petitioner states, in part, that "...the

[ Citizens'] Task Force issued its final report...[which] documented a number of serious safety and health problems that could arise with the completion and operation of... reactor (s) stating:

It is agreed that a radiation dose low enough to produce no effect has not been identified.

In 9ther words, all levels of radiation may produce some effect on cells.

It is also accepted that no plant works perfectly 100 percent of the time.

Intentional releases of radiation are routine.

Accidental releases also l

occur..."

"The establishment of an effective notification and evacuation system i

around reactors is essential if the public is to have confidence in its own health and safety. Any inadequacy in the level of emergency preparedness j

the current level of preparedness are changed..."

The petitioner requests that the Commission amend its regulations to require the following:

"1.

That the present ten-mile EPZ radius be extended to twenty miles and include any towns bordering to or partially within this zone...

2.

That all (such] communities with a population in excess of 5000 persons be provided by the respective utility with the funding to:

a.

purchase, install and operate radiological monitoring equipment, and; b.

reach and maintain the level of emergency and radiological preparedness deemed necessary by the affected mur.icipalities.

3.

That utilities be required to finance the emergency planning efforts of the 'cunicipalities around nuclear reactors."

The petitioner states that its request is based upon the following premises:

i "1.

Emergency planning and preparedness in support of co=1ercial nuclear power plants is presently inadequate and incapable of providing an acceptable level of radiological and emergency preparedness.

2.

Current flRC regulations governing the level of emergency preparedness will not correct the present inadequacies in a timely or acceptable manner."
