Dear Brother Kane:
By letter dated August 19, 1981 as supplenented by letters dated August 26, 1991 and Hovember 23, 1981, you sutnitted a revision of the Manhattan College Physical Security Plan for your zero power reactor, License No. R-94 He have reviewed the submittals and have concluded that the revision neets the require-nents of 10 CFR 73.67 for the protection of special nuclear naterial of moderate strategic significance. Since the current NRC-approved physical security plan should properly be reficcted in the license authorization for your facility, we are herewith issuing Anendnent No. 5 to Facility License !!o. R-94 which identifies your currently approved physical security plan.
Changes which would not decrease the effectiveness of your approved physical encurity plan nay he nade without prior approval by the Connission pursuant to the authority of 10 CFR 50.54(p). Changes which do require prior URC approval should he submitted and identified as license amendment requests.
You are required to subnit a transportation Physical Security Plan to the ICC at least 120 days prior to any anticipated shipnents or receipts of special nuclear naterial of noderate strategic significance (10 CFR 73.67(c))
or 10 tq or more of lou strategic significance (10 CFR 73.67(g)).
Based on the fact that this license anendment applies to the physical security plan and incerporates into the license the latest requirenents of your updated physical security plan, we have concluded that:
(1) the anendment does not involve a significant increase in the probability or conwquence of accidents previously considered, dees not involve a significant decrease in a safety nargin, and, therefore, does not involve a significant hazards consider-ation; (2) there is reasonable assurance that the health and safety of the public will not be endancered by this action; and (3) such activities will be conducted in cmpliance with tSe Connissio. , regulations and the issuance of this amendment will not be inimical to the com on defense and security or f

MAR 11 1992 Brother Gabriel Kane We have detemined that this anendnent will not result in any significant environnental irpact and that it does not constitute a najor Comnission action significantly af fecting the quality of the bunan environment.
We have also deternined that this action is not one of those covered by 10 CFR 51.5(a) or (b). Havinq riade these determinations, we have further concluded that, pursuant to 10 CFR 51.5(d)(4), an environnental icpact statement and negatives declaration need not be prepared in connection with issuance of this snendnent.
The documents conprising the currently approved physical security plan for the Phnhattan College reactor and our evaluation findings have been placed in the Conmission's files. Pursuant to 10 CFR 2.790(d), this information is being withheld from public disclosure.
It is required that this physical security plan be frplerented within 30 days from the date of issuance of this amendment.
