This is in response to your letter dated Decerter L,1921 which requested a limited exenption from the requircrents of 10 CFR 70.57(b)(11).
He have deternined that granting this exerrption will not adversely affect the comon defense and security nor the public health and safety and is otherwise in the public interest. Therefore, we are adding License Condition 4.8 to Safcpuards Amendrent IPP-1 of your License No. SUM-1107, effective imediately. This condition reads as follows:
4.8 Notwithstanding 10 CFR 70.57(b)(11) uhich requires an investigation and tirely corrective action whenever control data exceed the 0.05 control limits, the licensee shall follow Section 4.5.3 of the Plan identified in License Condition 2.1.
He have established that the attachnent to your letter dated Decerber 15, 1981 contains inferration of a type specified in 10 CFR 2.790(d). Accordi ngly, pursuant to Section 2.790(d)(1), such information is deered to be comercial or financial information within the reaning of 10 CFR
.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
