MEMORANDUM AND ORDER y

SETTING SPECIAL PREHEARING~ CONFERENCE 1.

A Special Prehearing Conference will be held on May 6,1982 at 9:30 a.m. (EST) for two days. The location of this conference will be the Portsmouth District Court,: 2nd Floon, Room 201,-

111 Parrott Avenu.e, Portsmouth, New Hampshir.e, 03801.

This conference will proceed in accordance with the provisions of 10 C.F.R. 5 2.751a set forth in full as follows:

5 2.751a Special prehearing conference in construction permit and operating license proceedings.

l (a) In any proceeding involving an application for.

a construction permit or an operating license for a pro-duction or utilization faci,lity, the Comission or the presiding officer will direct the parties and any peti-tioners for intervention, or their counse.1, to appear 4

at a specified time and place, within ninety (90) days

[5 after the notice of hearing is published, or such other time as the Commission or the presiding officer may deem l

appropriate, for a conference to:

(1) Permit identification of the key issues in the proceeding; (2) Take any steps necessary for further identifica-tion of the issues; B203170287 820312 l

(3) Consider all intervention petitions to allow the presiding officer to make such preliminary or final determination as to the parties to the proceeding, as may be appropriate; and (4) Establish a schedule for further actions in the proceeding.

(b) The presiding officer may order any further informal conferences among the parties, including tele-phone conferences, to the extent that he considers that such a conference would expedite the proceeding.

(c) A prehearing conference held pursuant to this section may be stenographically reported.

(d) The presiding officer shall enter an order which recites the action taken at the conference, the schedule for further actions in the proceeding, any agreements by the parties, and which identifies the key issues in the prcceeding, makes a preliminary or final determination as to the parties in the proceeding, and provides for the i

submission of status reports on discovery. The order shall be served upon all parties to the proceeding.

Objections to the order may be filed by a party within five (5) days after service of the order,' except that l

the regulatory staff may file objections to such order l

within ten (10) days after service. The board may revise the order in the light of the objections presented and, i

as permitted by 5 2.718(i), may certify for determination to the Comission or the Atomic Safety and Licensing Appeal Board, as appropriate, such matters raised in the objections as it deems appropriate. The order shall con-trol 'the subsequent course of. the proceeding unless l

i modified for good cause, l

This Special Prehearing Conference is a public conference (10 C.F.R.

I 2.751). However, no public written and/or oral testimony or limited l

appearances will be taken at this Special Prehearing Conference.

Copies of any Amended Petitions to Intervene will be filed in three (3) copies with this Board, addressed as follows:

Any document filed in accordance with paragraph 4 and not received by this Board on the thirtieth or fifteenth day respectively prior to the hearing date in paragraph I will not be considered by the Board.
