Appendix NOTICE OF VIOLATION Louise Burg Hospital License No. 12-18505-01 As a result of the inspection conducted on February 26 and March 1,1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

10 CFR 35.14 requires that sealed calibration or reference sources possessed pursuant to 10 CFR 35.14(d) be tested for leakage and/or contamination at intervals not to exceed six months, records of leak test results shall be kept in units of microcuries and maintained for inspection by the Commission.

Contrary to this requirement, it was learned through statements of licensee representatives and the NRC inspectors review of leak test records that this requirement was not being met.

Specifically, your 206 microcurie cesium-137 sealed source was not leak tested since August 27, 1980, a period in excess of the required six months.

This is a Severity Level V violation (Supplement VII).

10 CFR 20.201(b) requires that you make such surveys as may be necessary for you to comply with all sections of Part 20.

As defined in 10 CFR 20.201(a), " survey" means an evaluation of the radiation hazards incident to the production, use, release, disposal, or presence of radioactive materials or other sources of radiation under a specific set of conditions.

Contrary to this requirement, you failed to make such surveys as were necessary to assure compliance with 10 CFR 20.301, a regulation that describes authorized means of disposing of licensed material contained in waste. Specifically, between August 1, 1980 to March 1, 1982, you failed to survey disposed waste prior to disposing of the material to the normal cold trash.

This is a Severity Level V violstion (Supplement IV).

License Condition No. 13 requires that license material be possessed and used in accordance with statements, representations and procedures contained in application dated May 8, 1980.

Item No.17 of the appli-cation states that the procedures described in Appendix I of the NRC Medical Licensing Guide will be used for area surveys, Appendix I requires that all clution, preparation, and injection areas be surveyed daily and a permanent record will be kept, including negative results.

Contrary to this requirement, it was learned through statements of licensee representatives and the NRC inspectors review of area survey records that this requirement is not being met.

Specifically, daily surveys of the injection area were not performed.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
