' Appendix NOTICE OF VIOLATION C. P. Clare and Company License No. 12-16676-01 As a result of the inspection conducted on February 16 and 17, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
1.
10 CFR 20.105(b) requires that radiation levels in unrestricted areas be limited so that if an individual were continuously present in the area, he could not receive a dose in excess of 2 millirems in any hour or 100 millirems in any seven consecutive days.
Contrary to this requirement, on the day of the inspection, radiation levels existed along the fence enclosing your krypton-85 gas cylinders of such a magnitude that if an individual had been continuously present in the area, he could have received a dose in excess of 2 millirems in any hour. Specifically, the radiation level at 18 inches from the fence (an unrestricted area) was 4 millirems per hour.
This is a Severity Level IV violation (Supplement,IV).

10 CFR 20.203(b) requires that each radiation area be onspicuously posted with a sign or signs bearing the radiation caution symbol and the words:
" Caution Radiation Area."
Contrary to this requirement, on the day of the inspection, the fence enclosing your krypton-85 cylinders was not posted as required.
This is a Severity Level V violation (Supplement IV).

10 CFR 20.201(b) requires that such surveys be conducted as may be necessary for the licensee to comply with all sections of Part 20.
Contrary to this requirement, it was learned through statements of licensee representatives you failed to perform surveys to ensure compliance with 10 CFR 20.105(b), a regulation which limits the radiation levels in unrestricted areas. Specifically, you failed to perform surveys in the unrestricted area around the fence enclosing your krypton-85 cyl-inders.
This is a Severity Level V violation (Supplement IV).
4.
License Condition No. 13 requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in application dated November 24, 1980.

application states the survey meter used in the radiation safety program will be calibrated every month.
Contrary to the above, it was learned from statements of licensee representatives and the NRC inspectors review of the records, that this requirement was not met.
Specifically, Baird-Atomic, Inc.,
Model 904-122(420), Serial No. 17007, was calibrated June 19, 1981, and February 1982. This frequency of calibration is in excess of the monthly calibration requirement.
This is a Severity Level V violation (Supplement VII).

this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
