Dear Mr. Eisenhut:

We would appreciate learning why you gave Consumers Power Company an order extending construction completion dates, even though the Consumers Power Company request was filed on the 22nd of July, 1981.

The extension was requested due to "a significant increase in quanti-ties of projected bulk commodities." The Mapleton Intervenors would like to know if the quantities of projected bulk commodities has some-thing to do with the settling of the various structures in the Midland flood plain or whether these bulk commodities are extra equipment that is being ordered in to rectify past mistakes. The other reason for your extending the construction date was the strike which occurred in May, 1978, and lasted for 44 days. We do not understand how 44 days can develop in 2 years for additional construction.

The action, in our opinion,-does call for the preparation of an environ-mental impact statement for this particular site, due to the fact that it is sited on a flood plain and from all the correspondence and literature and documentation that has been made available to the Maple-ton Intervenors, it appears that there will be much trouble in keeping l this site dry. The fact of the matter is, your own witnesses testified that flood plain situation soils can never be stabilized, the reason being that flood plain materials, as unconsolidated sediments constantly change their water content depending upon river and ground water conditions. So stabilization as compared to, say, upland soils or unconsolidated sediments, when there is not such a copious water supply, is really poor. To us this appears to be the key to the whole situation.

We wonder if your extension of the building permit time has not something to do with the testimonies before the licensing board.

As requested, we would appreciate information from you concerning the above matters. Please advise.
