Department of the Interior Geological Survey-Uestern Region 345 fliddlefield Road Menlo Park, California 94025 License flo. 04-06674-07 As a result of the inspection conducted February 4-5, 1982, and in accordance with the_Interin Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
A.
10 CFR 30.41(a), (b) states, in part, that a licensee shall not transfer byproduct material except to another licensee of the Comission who is authorized to receive the material under the terns of the transferee's license.
Contrary to the above reouirement, a sealed source (americinn-241, 110 nillicuries) was transferred on January 5,1978 to the U. S. Geological Survey located in Carson City, Nevada, which was not authorized to receive the naterial under the tems of the transferee's license. The inspector verified that the transferee's NRC license (Number 27-17597-01) at the time of receipt of the material, specified for americium-241 a maximum possession limit of 100 millicuries per source.
This is a Severity Level IV Violation (Supplement VII).
B.
10 CFR 30.41(c) states, in part, that before transferring byproduct naterial to a licensee of the Comission, the licensee transferring the material shall verify that the transferee's license authorizes the receipt of the type, fom, and quantity of byproduct material to be transferred.
10 CFR 30.41(d) also states that a record shall be maintained which verifies that the transferee's license authorizes the receipt of transferred byoroduct naterial.
Contrary to the above requirements, at the time of the inspection, a record of verificatien of licensee authorization to receive licensed r
material was not maintained for one sealed source (110 mci, americium-241) which was transferred on January 5,1978 to the U. S. Geological Survey located in Carson City, Nevada.
This is a Severity Level V Violation (Supplement VII).
l Pursuant to the provisions of 10 CFR 2.201, U. S. Geological Survey, Meno Park is hereby requi,ed to submit to this office within thirty days of the date of this flotice, a written statement or explanation in reply, including:
(1) the corrective stens which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of nonconpliance; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
