( ) June 17,1977 The EPA Administrator issued his long awaited decision reversing an earlier decision by the EPA Regional Administrator who had ruled against the plant in November 1976.
In his decision, the Administrator af firmed the RA's initial finding that the plant's intake stiuctures should be at the "far site", which is 7000 feet at sea and 4000 feet beyond the original location proposed by PSNH; found that the adult Mya (clam) population would not be significantly reduced by larvae deaths caused by heat, and found that the intake and discharge tunnels represent best technology available in design and location of the cooling system.
June 17,1977 PSNH filed a motion before the NRC, ASLB and ASLAB for an Order reinstating the Construction Permits, due to reversal of the EPA Regional Administrator's decision.

Oc tober 7,1977 In an Order, the Court denied SAPL/Audubon's September 16 request for an immediate stay of construction and suspension of the EPA Administrator's decision of June 10, 1977 (issued June 17,1977), on the basis that it had not had an opportunity to examine the issues, was unconvinced of resulting irreparable harm, and that the appeal would be briefed and argued at a November hearing.
November 30, 1977 The Board released its second Supplemental Initial Decision to its June 29, 1976 Initial Decision which authorized the issuance of Construction Permits f or Seabrook using once-through cooling and rejected the alternate closed-cycle cooling. In this latest supplement, the Board concluded that:
(a) the benefits of Seabrook with natural draf t cooling towers outweigh its costs, and (b) none of the proposed alternate sites is obviously superior to Seabrook, even if one ignores the f act that Seabrook is closer to completion.

April 13,1978 In response to the Court 's February 15, 1978 mandate to the EPA Administrator, PSNH filed a motion to have the Court either grant a rehearing or to recall its mandate and vacate the decision on the basis that the major factual premise of the Court's decision was in error. PSNH petitioned the U.S.
Supreme Court to grant a writ of certiorari to review the February 15, 1978 judgment and opinion of the U.S. Court of Appeals for the First Circuit which overturned the EPA Administrator's decision on the once-through cooling system for Seabrook, and to vacate and remand the case to the Court of Appeals for reconsideration.

The Construction Permits were allowed to remain in full force and effect pending the outcome of the further proceedings, unless the NRC should order otherwise.
May 3, 1978 SAPL/Audubon petitioned the Court for revie. vf the Appeal Board's April 28, 1978 Order and Decision (ALAB-471), which declined to suspend the Construction Permits while reversing the Licensing Board's two Supplemental Initial Decisions.
May 10, 1978 PSNH petitioned the NRC for a review of that portion of the Appeal Board's April 28, 1978 decision (ALAE-4 71) which reversed and remanded the Licensing Board's two Supplementary Initial Decisions.
May 19, 1978 The Court, in a Memorandum and Order, denied the SAPL/Audubon motion for a stay of the decision authorizing construction, and stated its willingness to await whatever guidance the full Commission choores to of fer before releasing its decision.
