SECY-82 Petition for Reconsideration and Request for Immediate Suspension of New Safeguards Information Regulations Implementing Section 147 l
The Commission, by a vote of 4-l -(Commissioner Roberts disapproving),
approved an Order denying a petition for reconsideration of final rules implementing Section 147 of the Atomic Energy Act and requesting imediate suspension of certain specified rules c'1 telecommunications and storage requirements. Commissioner Roberts would have suspended the effective date of the requirements until the Commission received a presentation by KMC and the NRC staff.

SECY-82 F0IA Appeal (81-A-21)
The Commission, by a vote of 3-12 (Commissioner Bradford disapproving and Comissioner Gilinsky abstaining), approved a letter denying an F0IA request by Paul Leventhal, President o.f the Nuclear Club, Inc.

(Subsequently, on 2/26, the letter was signed by the. Secretary.)
I Section 201 of the Energy Reorganization Act, 42 U.S.C. 55841, provides that action of the Commission shall be. determined by a " majority vote of the members present." Commissioner Ahearne was not present when this item was affirmed, but had previously indicated his approval of the Order.
Had Commissioner Ahearne been present, he would have affirmed his prior vote.
Accordingly, the formal vote of the Commission was 3-1 in favor of the decision.
