The Commission continued its discussion of the Department,of Energy request that the NRC grant an exemption from 10 CFR 50.10 pursuant to 10 CFR 50.12 to conduct site preparation activities for the Clinch River Breeder Reactor.
The Commission by a vote of 3-2 (Commissioners 0:linsky, Bradford and Ahearne approving, Chairman Palladino and Commissioner Roberts disapproving) approved an order (SECY-82-94 as modified below) denying the DOE request.
The Comission agreed to modify the draft order by deleting a reference that the Commission would publish separately a statement of reasons underlying the decision and adding that separate views of individual Commissioners would be attached.
