January 29,1982" (February 16,1982). As to the issue of whether to grant NIPSCO's August 26,1981, "Hotion to Teminate Proceeding" and the three i

subissues which have arisen (whether the Board need retain jurisdiction over this proceeding until conpletion of restoration, whether the temination j

should be with or without prejudice, and whether PCCI's litigation costs should be assessed against NIPSCO), the Staff rests upon its previous i

The Staff's position on the need for the Board's retention of jurisdiction does, hcwever, require reemphasis in view of the Board's misperception of that position reflected in its " Order (Requiring NIPSCO to Inplement Revised Plan)."
