Dear Mr. Murray:
Your letter of February 8,1982, has been filed in a proceeding involving an application for a license amendment to permit the expansion of a spent fuel pool at Big Rock Point nuclear power plant.
In your letter, you stated that " Prohibited Areas are designated only for -
security or other reasons associated with the national welfare." You con-cluded that it was not necessary to restrict overflights of the Big Rock Point Plant to protect the " national welfare".
In our official capacity, we are charged in part with protecting the health and welfare of the public from radioactive releases that might occur were an aircraft to strike the Big Rock Point Plant, which has a containment building that is not reinforced by concrete and that cantains a substantial inventory of radioactive materials.
Consequently, we would appreciate re--
ceiving any risk analyses or legal analyses which you may have performed in order to reach the conclusions contained in your February 8 letter. To pro-vide you with further information about the nature of our interest, we are enclosing our Memorandum and Order of February 19, 1982. The discussion

beginning in the last full paragraph on page 43 and ending in the middle of page 44 oJtlines the nature of the allegations which must be adjudicated by us.
