'48 The staff has received your letter directed to the Secretary of the Connission dated January 14, 1982, which contained your request for an extension of the comment period on the Byron Station Draf t Environmental Statement (DES). Additionally, we have been advised by the Office of the Secretary that your letter was just received this week.
As you are aware, the corrent period for the Byron DES expired on January 18, 1982. The Federal Register of Friday, December 4, 1981 (46FR59350) announced the connent period and indicated that connents should be forwarded to the Ofrector, Division of Licensing, Office of Huclear Reactor Regulation prior to the expiration of the comment period. A similar notice was also published by the Environnental Protection Agency (46FR59299).
Because the comment period was properly scheduled and noticed, and since the Final Environmental Statement is scheduled to be published in early April 1982, the staff rioes not intend to extend the already expired DES connent period. The staff will endeavor to acconmodate late responses to the extent that they can be evaluated without impacting the scheduled issuance of the Byron Final Environnental Statement.
