AUTHORITY'S OPPOSITION TO NEW YORK CITY COUNCIL PETITION FOR LEAVE TO AMEND PETITION-FOR INTERVENTION TO ADD ADDITIONAL SIGNATORIES At the special pre-hearing conference held on December f-2,1981, the Atomic Safety and Licensing Board (Licensing Board ) set December 10, 1981, as the deadline ~"for L

This amended petition, therefore, is untimely and, as such, should not be granted.1 Even if the petition were timely, Members still have f ailed to cure deficiencies in their petition to intervene concerning authorization to represent the Council of the City of New York (Council) in this proceeding:

(1)

Members have not submitted a resolution from the Council stating its intention to intervene in this proceeding; and (2)

Members have not submitted a document from the Council authorizing Members to intervene on the Council's behalf.

CONCLUSION Inasmuch as the defects therein have not been cured by amendment, the Power Authority of the State of New York requests that the Atomic Safety and Licensing Board deny the 1.
