This letter is in response to our discussion on January 11, 1982 at the Midwest Compact Committee meeting regarding spent fuel shipment notifica-i tions.

I have enclosed a copy of my letter dated April 24, 1981,to Maury Neuweg of your office on this subject, for your convenience.

Part 73.21 (b) (2) (ii), effective October 22, 1981 classifies schedules and itineraries for spent fuel shipments as being Safeguards Information t

(SI) requiring protection under this section. Part 73.21 (g) (3), effect-ive January 20, 1982 specifically prohibits the use of unprotected tele-communications circuits for the transmission of Safeguards Information except under emergency or extraordinary conditions.

I have enclosed the relevant portions of these regulations for your information. The advance notification requirements of these regulations are effective on July 6, 1982.

Chapter 1113, paragraph 218 (a) of the Illinois Radiation Protection Act 5

states, "All intrastate and interstate carriers of spent nuclear fuel in the State of Illinois are hereby required to notify the Department of Nuclear Safety twenty-four hours prior to any transportation of spent nuclear fuel within this State of the proposed route, the place and time of entry into the State, and the amount and the source of the fuel. The Department shall immediately notify the State Police which shall notify j

the Sheriff of those counties along the route of such shipments."

The time of entry into the state constitutes Safeguards Information and must be protected in accordance with 10 CFR Part 73.
