Dear Ralph:

On January 6, 1982 the NRC published in the Federal Register, final rules contained in 10 CFR Parts 71 and 73 regarding requirements for advance notifications to governors concerning shipments of Type B quantities of nuclear waste and irradiated reactor fuel. These final rules are effective on July 6, 1982.

On October 22, 1981 the NRC published in the Federal Register, final rules contained in 10 CFR Parts 2, 50, 70, and 73 regarding protection of unclassi-fled safeguards information. Part 73.21 (b) (2) (ii), effective October 22, 1981, classifies schedules and itineraries for spent fuel shipments as being Safeguards Information (SI) requiring protection under this section.

Part 73.21 (g) (3), ef fective January 20, 1982, specifically prohibits the use of unprotected telecommunications circuits for the transmission of Safeguards Information except under emergency or extraordinary conditions.

I have enclosed the relevant portions of these regulations for your information.

Since some states in NRC Region III have their own advance notification regulations, you may wish to familiarize yourself with these new require-ments to ensure that Safeguards Information is being appropriately protected in the State of Indiana.
