NRC Inspection This refers to the routine safety inspection conducted by.Mr. Grayson of this office on December 17, 1981 of activities authorized by NRC License No. 46-19584-01 and to the discussion of our findings held by Mr. Grayson with you and other members of your staff at the conclusion of the inspection.

During this inspection, it was found that certain of your activities appeared to be in noncompliance with NRC requirements. The items and references to the pertinent requirements are listed in Appendix A.

These items have been categorized into severity levels as described in the Federal Register Notice (45 FR 66754) dated October 7,1980.

Item A in the attached Notice of Violation is classified as a Severity Level III Violation in accordance with the Interim Enforcement Criteria.

As stated in Section IV.B of the Criteria, monetary civil penalties are normally assessed for Severity Level III Violations. After careful consideration of this specific violation, we have determined that civil penalties are not appronriate. Similar violations of this type in the future may result in imposition of civil penalties.

In addition to the need for corrective action regarding the specific items of noncompliance included in Appendix A, we are concerned about the implementation of your management control systen that permitted the items of noncompliance to occur. Consequently, in your reply you should describe in particular those actions taken or planned to improve the effectiveness of your overall management control system.

The responses directed by this letter and the accompanying flotice are not subject to the clearance procedures of the Office of ?!anagenent and Budget ::s required by the Paperwork Reduction Act of 1980, PL 96-511.

!!e have adopted a new HRC enforcenent policy, as described in the Federal Register Motice (45 FR 66754) dated October 7,1980.

!!ith the adoption of that policy we are requirino, under the authority of Section 182 of the Atomic Energy Act of 1954, as anended, that responses to flotices of Violations be subnitted under oath or affirnation. Therefore, the last paragraph of your letter should include a statement equivalent to the following:

"I certify that all information conta#aed in this letter including any supplements attached thereto, it true and correct to the best of ny knowledge and belief."
