February 18, 1982 MEMORANDUM AND ORDER (Concerning Notion to Compel)
On December 30, 1981, Cleveland Electric Illuminating Company (appli-cant) filed a Motion to Compel Answers to Interrogatories and Request for Production of Documents. The Interrogatories and Request for Production of Documents had been served on Mr. Tod J. Kenney on October 15, 1981.
Mr. Kenney has not complied with applicant's October 15, 1981, motion

and has not responded to the Motion to Compel.
Under the circumstances, we have decided to grant the Motion to Compel.
Mr. Kenney may either comply with our order or arrange, prior to March 15, 1982, to be consolidated with.
another party.
If he does neither, the Board will consider dismissing him as a party.
ORDERED:
That the Motion to Compel is granted and that Tod J. Kenney shall have until March 15, 1982, to respond to Cleveland Electric Illumina-ting Company's October 15, 1981, Interrogatories and Request for Production of Documents.
In the alternative, Mr. Kenney may arrange, prior to March 15, 1982, to be consolidated with another party.
