Dear Mr. Nemethy:

This responds to your letter of January 3,1982, that raises tw As questions concerning the Federal Register notice of flovember 6,19 (46 FR 55085), " Removal of Certain Information Collection Requirements for Tritium."

... how this ruling affects the disposal of the stockpile of tritium now on hand at Three Mile Island - in the water that was removed from the broken-down reactor?

The final rule had no effect on the disposal of the stockpile of tritium at TMI-2.

The information collection requirements removed (see enclosed 10 CFR 30.54, 30.55(a),150.18,150.19(a)) required control and accounting procedures for tritium in the possession of certain specific licensees and required fluclear Transaction Reports from each licensee who transferred or received at any one time 1,000 curies or more of tritium. The information collection requirements neither authorized nor prohibited transfer or disposal of tritium.

"Does it mean General Public Utilities will now be able to dump this water into the Susquehanna River without further ado?"

No, the release of water to the river is presently prohibited by the l

Commissior's statement of May 25, 1979, on preparation of an Environmental Assessment for the operation of the EPICOR-2 system and by the NRC staff order of February 11, 1980, that impos~ed a new set of formal license requirements to reflect the postaccident condition of TMI-2.

. JAN 2 G 1982 In summary, please be assured that no option for disposition of the processed water was foreclosed or enhanced by the removal of the information collection requirements for tritium from the Commission's regulations.
