Dear Administrative Judges:

At the recent hearings I distributed to the Board and all parties a letter from ifr. Youngblood, NRC, to Mr. Borgman, CG&E, dated February 2, 1982 requesting additional in#nmation on the Evacuation Time Study pre-pared by Stone and Webster which is physically incorporated in all of the relevant county radiological energy response plans. The Board requested that the Staff analyze the requested infonnation and report to the Board and parties its evaluation thereof, and confirmed that request in its order dated February 11, 1982.

It is my understanding that CG&E's response will be sent early next week. The Staff has arranged fer its consultant, Mr. Thomas Urbanik, Director, Texas Transportation Institute, to review CG&E's response and to appear at 9:00 a.m. Monday, March 1, 1982 at the re-convened hearings in Cincinnati to present the Staff's evaluation and to respond to questions from the Board and the partie3.

I have contacted the parties and they are agreeable. Mr. Urbanik has other comitments later that week and Monday is the only time available to him. However, if the material received from CG&E is incomplete or requires more analysis than currently anticipated, Mr. Urbanik will have to appear at a later hearing session to respond to Board Questions.

At our request, Mr. Urbanik has made this a priority matter but the Staff is currently unable to determine whether D567

sufficient time will be available to meaningfully address the new CG&E material after is has been submitted.

The Staff has reviewed the record of the past two weeks of hearing on emergency planning. We note the Board's questions regarding the rela-tion of standard operating procedures (S0Ps) to the state and county radiological emergency response plans. We also note Itr. Dennison's ques-tions regarding the substance of those SOPS. We also note the Boards interest in the matter of timing, i.e., an evidentiary hearing prior to FEt4A review and approval of off site emergency response plans. The Board has set the week of March 1,1982 to complete the evidentiary hear-ing and for rebuttal witnesses. fir. Brian K. Grimes will appear for the Staff as a rebuttal witness to address these matters, which are outside the purview of any admitted contention. Mr. Grimes is the Director of the Division of Emergency Preparedness of NRC's Office of Inspection and Enforcement. Mr. Grimes is also a principal co-authorof NUREG-0654 Criteria For Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants and a Co-Chairman of the FEMA /NRC Steering Committee. Mr. Grimes schedule is such that his appearance should be scheduled for Tuesday, March 2,1982 as the first order business that morning, if possible. We will appreciate the Board confirming Mr. Grimes' appearance so we, and all parties, may adjust our schedule.
