Appendix NOTICE OF VIOLATION Mercy Hospital License'No. 21-15638-01 As a result of the inspection conducted on January 12, 1982, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754-(October 7, 1980), the following violations were identified:
1.
10.CFR 35.14(e) requires that sealed calibration or reference sources possessed pursuant to 10 CFR 35.14(d) be tested for leakage and/or contamination at intervals not-to exceed six mcnths.
, Contrary to this requirement, as of the day of the-inspection, you failed to leak test your 218 microcurie sealed cesium-137 calibration M since January 28, 19811

This is a Severity Level V violation (Supplement VII).
2.
License Condition No. 17 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated April 15, 1978, and letter dated May 31, 1978.
Item No. 7 of the above referenced application states that the Medical Isotopes Committee shall meet not less than once in each calendar quarter.
Con;tsry to this requirement, the Medical Isotopes Committee last met on April 29, 1981.
Thi.s is a Severity Level V violation (Supplement VII).

License Conditica No. 17 requires that licensed material be possessed and used in accordance with statements, representation, and procedures
-contained in application dated April 15, 1978, and letter dated May 31, 1978.
Item No. 10 of the above referenced application states that survey instruments will be calibrated at least annually and following repair.
Contrary to this requirement, your Victoreen 740D survey meter was last.
calibrated in October 1980.

Applications. for Medical Programs will be followed in calibration of -
the dose calibrator.
Appendix D, Section 2 procedures require the dose calibrator linearity tests be performed over a 48 hour5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> period.
' Contrary to the above, linearity tests of the dose calibrator were performed over an eight hour period only.
This is a Severity Level V violation (Supplement VII).
Pursuant to the provisions of.10 CFR 2.201, you are required to s_ubmit.to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the'date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of'1954, as amended, this response shall be submitted under oath or affirmation.
Consideration may be given to extending your response time for good.cause shown.
