Dear Dr. Sencer:

0 This confirms the discussion Mr. Ashley held with fir. Jean Cropper and Dr. Leonard Solon following our recent review of the New York City radiation control program. The review covered the principal admini-strative and technical aspects of the Department's program. This included an examination of the program's funding and personnel resources; an examination of emergency response capability for agreement materials; and the status of the Department's radiation control regulations. There was also a review of selected licensing, inspection and enforcement activities. In addition, we conducted field accompaniments of two City inspectors during this review.

Our review used as a reference, the ilRC " Guide for Evaluation of State Radiation Control Programs, " Revisi n 3, dated February, 1980. The Guide was published in the Federal b gister as a proposed NRC policy statement on October 3, 1980 and public comments solicited. The Guide provides 37 Indicators for e*,.iluating Agreement State program areas.

Guidance as to their relative importance to an Agreement State program is provided by dividing the Indicators into three categories. When serioat problems are found in program areas for which Indicators are in Categories I or II, we will need additional information in the form of responses to our letters to you and the radiation control program director before we can offer staff opinions on the adequacy and compatibility of the program. A copy of the Guide was provided to ;1r. Cropper to give to you.

As a result of our review of the Department's program and the routine exchange of information between the Nuclear Regulatory Commission (NRC) and the Department, the staff believes that the Department's program for regulation of agreement material is adequate to protect the public health and safety and compatible with the Commission's program.

Sencer, M.D. We were pleased to learn that the Bureau for Radiation Control was expecting delivery of a liquid scintillation counter in December,1981 to enable the Bureau to have the capability to independently analyze low energy beta samples collected in the field by inspectors. At the same time, the Bureau has other laboratory and radiation monitoring instruments that are quite old and not always reliable. We urge your consideration in getting these instruments replaced. The implementation of the new licensing and inspection fee system by the Bureau should be an aid in providing the necessary funding.

We understand the Bureau is to be moved to new quarters sometime in 1982. As discussed with Mr. Cropper, we believe it is important that sufficient working space be allowed for both licensing and compliance personnel.

The technical aspects of the agreement material program were discussed with the staff in detail.

I am enclosing for your information a copy of a letter to Dr. Solon with comments regarding those aspects of the program. I am also enclosing a copy of this letter which should be placed in the City's Public Document Room or otherwise made available for public inspection.

I appreciate the courtesy and cooperation extended to Mr. Ashley and Mr. Gordon during the meeting with your staff.
