SUBJECT:
GE FAULT TREES (LIMERICK PRA) - IMPACT OF PUBLIC DISCLOSURE On November 9,1981, Mr. Troy B. Conner, Jr. of Conner & Moore, as counsel for Philadelphia Electric Company, requested return of all copies of the General Electric fault trees submitted to the NRC previously in connection with The Limerick Probabilistic Risk Assessment.
On November 24, 1981, Mr. Conner requested that the NRC withhold these fault trees from public disclosure in accordance with 10 CFR 2.790(b)(4).
Subsequently, on December 5,1981, in a telephone conversation with Mr. Edward Shomaker of the Office of Nuclear Reactor Regulation, Mr. Conner indicated that his request to return the fault trees is moot at this time.
On December 9,1981, the NRC staff approved the November 24, 1981 request that these fault trees be withheld from public disclosure on the basis that they contain commercial data, the release of which would cause substantial harm to the General Electric Company.
Since withholding from public disclosure has not Deen denied, return of the fault trees in accordance with the provisions of 10 CFR 2.790(c) is no longer appropriate.
Based on the above, no further reply to Mr. Conner's November 9,1981 letter is necessary or appropriate.
