Dear Sir:
Our letter of January 4, 1982 provided a status of the prompt notification system being installed in the James A. FitzPatrick Nuclear Power Plant 10 mile EPZ.
That letter indicated that all equipment, except 600 tone alert radios not considered in the ori-ginal design, would be installed and tested by December 31, 1981.
This letter is to inform you that the prompt notification, as designed, was installed and tested by December 31, 1981.
- However, these additional tone alert radios were not received until Jan-uary 22, and 26, 1982.
Therefore, it wil? not be possible to test and distribute these by February 1, 1982.
Over 500 of these additional tone alert radios will be used outside of the 10 mile EPZ but within the local geographic Emergency Planning Zone.
The remainder will be used to correct for population migration changes from the original design date to the present date.
While incle-ment weather may hamper distribution of these additional radios, they will be distributed by February 26, 1982.
Since these 600 tone alert radios are not part of the original design, the Power Authority believes that the four month grace per-iod allowed by 10 CFR 50.54 (s) (2) as amended December 23, 1981, is applicable.
Section IV.D.3 of 10 CFR Appendix E specifically per-mits grace period for correction of deficiencies identified during initial installation and testing.
The Authority considers this a deficiency which warrants relief beyond February 1, 1982.
