Docket Nos. 50-445 and 50-446 Gentlemen:
I an writing in reference to the " Joint Motion To Dismiss Contention 1" (" Joint flotion") and " Stipulation" filed by CFUR and the Applicants on January 19, 1982.
In the Stipulation, CFUR withdrew Contention 1, but Applicants and CFUR agreed that the Stipulation "is contingent upon its acceptance by the NRC Staff and upon dismissal of Contention 1 by the Licensing Board..." (Stipulation, at 2). As you are aware, on January 25, 1982, the Atonic Safety and Licensing Board ("the Licensing Board") granted the Joint Motion and disnissed Contention 1.
The Staff has reviewed the Stipulation and finds it to be aTceptable.
Accordingly, that contingency in the Stipulation has been satisfied.
