Appendix NOTICE OF VIOLATION X-Ray Treatment Center, P.C.

License No.-21-19572-01 As a result of the inspection conducted on January 11, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

10 CFR 35.25(b)(1) requires the licensee to maintain, for inspection by the Commission, records of spot check measurements and corrective actions under 35.22.

Contrary to the above, you failed to maintain the following records as part of your monthly spot check; (1) congruence between the radi-ation field and the light field, (2) accuracy of all distance measuring devices, and, (3) the percent difference between the measured output and the expected output.

This is a Severity Level VI violation (Supplement VII).

2.

10 CFR 35.25(b)(2) requires the licensee to maintain, for inspection by the Commission, records of calibration of instruments used to make spot check measurements.

Contrary to the above, as of the day of this inspection, you failed to maintain the required instrument calibration records.

This is a Severity Level VII violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

Consideration may be given to extending'your response time for good cause shovn.
