Appendix NOTICE OF VIOLATION G. D. Searle and Company License No. 12-00701-02 As a result of the inspection conducted on January 7 and 8,1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified:
License Condition No. 20 requires that licensed material be possessed and used in accordance with statements, representations, and procedures con-tained in application dated March 26, 1979; and letters dated July 3, 1979 and January 29, 1981.
Item 11a of the application states monitoring instru-ments listed in Attachment 3 will be calibrated at six month intervals.
Contrary to the above, it was learned from statements of licensee representa-tives and the absence of records, that this requirement was not met.
Spec-ifically, with the exception of Model PUG-1, (not used) all monitoring instruments cited in Attachment 3 were not calibrated semiannually.
This is a Severity Level V violation (Supplement VII).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3)'the date when full com-pliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
