g John Shniper, Esquire, is an attorney who has filed a pro g

petition to intervene.
He has advanced two contentions, III-2 and V-10, as part of the coordinated filing of contentions by petitioners. The Applicant and NRC Staff, in their written answers, objected to the admis-sion of these two contentions either in whole or in part.
The Board has not yet determined whether Mr. Shniper's two contentions are admissible.
Mr. Shniper has not filed a response to the objections to his conten-tions in default of the provision in the Board's orders to do so by December 21,1981.1/ In addition, Mr. Shniper did not appear at the 1/ emorandum and Order Setting Schedule for Submission of Contentions Mand Other Preliminary Information, October 14, 1981; and Memorandum and Order Adjusting Schedule and Clarifying Status of Limited Appearors, November 9, 1981.

- First Special Prehearing Conference, held in Norristown, Pennsylvania on January 6-8, 1982, to discuss inter alia his contentions and the object' ions thereto.
This failure to appear, without explanation, was in default of the Board's order to all petitioners to attend the conference.2/
If Mr. Shniper still wishes to become a party to this proceeding, he is directed to show cause, within five days of the date of service of this order why he should not be dismissed for his defaults noted above, pursuant to 10 CFR 2.707 and 2.718. Cf. Public Service Company of New Hampshire (Seabrook, Units 1 and 2), ALAB-488, 8 NRC 187 (1978). Mr. Shniper shall include ths reasons why he did not file a written response to the objections to his contentions and why.he could not be in attendance at any time during the three day prehearing conference.,_ He shall also include the reasons why he did not seek relief in advance from the requirement to attend the prehearing conference.
If Mr. Shniper does not respond to this order, he will be dismissed from the proceeding.
If Mr. Shniper does respond, other parties and participants are invited to express their views on whether Mr. Shniper 2/ otice of Special Prehearing Conference, December 4, 1981.
