APPENDIX A f{0TICE OF VI0t.ATION U. S. Department of the Interior License No. 04-15259-01 Nureau of Indian Affairs 2800 Cottage Way Sacramento, California 95825 Es a result of the inspection conducted December 16, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

A.

License Condition 12 states that licensed material shall be used by, or under the supervision and in the physical presence of individuals specifically named in the license.

Contrary to the above requirement, an employee who was not named in the license as an authorized user, used a gauge and was not under the supervision or in the physical presence of an individual named on the license. The employee had successfully completed the training provided by Campbell Pacific Nuclear Company prior to using the gauge.

This is a Severity Level IV Violation (Supplement VII).

B.

License Condition 17 states, in part, that except as specifically provided otherwise by this license, the licensee shall possess and use licensed naterial in accordance with statements, representations and procedures contained in application dated July 25, 1977.

Item 11 of the application dated July 25, 1977 requires that survey instruments be calibrated on an annual frequency.

Contrary to the above requirement, at the time of the inspection, the radiological mointoring instruments CDV-715 Model 18, Serial Number 162839 and CDV-700 Model 63, Serial Number 55238 were last calibrated on 7-14-77 and 7-28-77 respectively, a period in excess of four years and five months.

This is a Severity Level IV Violation (Supplement VII).

C.

10 CFR 20.407 requires that all licensees other than those described in 10 CFR 20.408 shall within the first quarter of calendar years 1979 and 1980, submit to the Commission, the personnel monitoring reports specified in 10 CFR 20.407(a) and (b) covering the calendar years of 1978 and 1979.

Contrary to this requirement, at the time of the inspection, the personnel monitoring report for the calendar year 1979 had not been submitted to the Comission.

This is a Severity level VI Violation (Supplement VII).

1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further itens of noncompliance; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
